CONDITIONS OF SALE
Definitions and Law
The complete Contract is the document or documents that set out the terms and conditions and all other details relevant to a particular transaction and is hereinafter referred to as 'the Contract'.
The goods sold by the Seller to the Buyer. Shall hereinafter be referred to as 'the Goods'
The person, firm, company, corporation or public authority shown as the invoicee is 'the Buyer'.
The parties to the Contract are the Seller of the Goods and the Buyer.
The person, firm company, corporation or public authority responsible for the delivery of the Goods to the delivery address, including the Seller when the Seller delivers, shall, hereinafter be referred to as 'the Carrier'.
The person, firm, company, corporation or public authority to which the Goods are delivered when it is not the Buyer is hereinafter known as 'the Recipient'.
This contract shall be governed by and construed in accordance with the law of England.
Risk and Title of Goods
The risk in the Goods shall pass to the Buyer immediately on delivery to the Buyer or to the Recipient.
The property in the Goods shall remain vested in the Seller until all monies due to the Seller as detailed in the Clause headed 'Payment' have been paid by the Buyer to the Seller in full.
Receipt
The Buyer or Recipient on behalf of the Buyer, shall receive and unload the Goods and shall check the same for quantity and condition in the presence of the Carrier. If there is a shortage or if the Goods are, in an unsatisfactory condition, the Buyer or Recipient must so endorse the Carrier's delivery document and must give separate written notice thereof to the Seller within three days of delivery. If this condition is not observed, no claim In respect of shortage or of unsatisfactory condition of the Goods will be entertained. This condition does not affect the statutory rights of the Buyer.
Price
The price charged will be the price ruling at the time of delivery. Where this is at variance with the price quoted when the Goods were ordered the Buyer will be advised prior to delivery.
Payment
Where monthly account facilities have been granted to the Buyer in writing, all invoices must be paid by the last day of the month following the month of delivery, where no such facilities have been granted payment will be with order or where previously agreed on delivery. Where these terms are exceeded the Seller shall be entitled to interest on the amount that is overdue at the HSBC Bank PLC base rate plus 4% calculated on a day to day basis. This shall be without prejudice to any other rights or remedies of the Seller. The Buyer will pay any legal charges incurred in the recovery of money or Goods.
When the Contract Comes into Being
The Contract shall come into being between the Buyer and Seller when the Buyer has placed an order, detailing his requirements and agreeing to be bound by these conditions, and the Seller has accepted the order.
When Signature for Receipt of Goods Becomes Operative
Where, for administrative convenience, the Buyer or his agent is requested by the Seller to sign a contract and/or delivery note before the Goods are handed over, the Buyer or his agent agrees to examine the Goods at the time of the physical hand-over and the effect of such signature in respect of receipt of the Goods will not become operative until immediately after the physical hand-over.
Rights Reserved
Any failure by the Seller to enforce any or all of these conditions shall not be construed as a waiver of any of the Seller's rights hereunder.
Separate Term Validity
Should any term in this Contract be held invalid such invalidation shall not affect the validity of the remaining terms. Headings in these conditions are for reference purposes and shall not affect the interpretation of these conditions.
Terms of Contract
These conditions have effect in substitution for and to the exclusion of, any Condition put forward by the Buyer.
Notice for customers wishing to purchase outside of the UK
A carriage surcharge may be applied on heavy items for shipments outside of England, Scotland, Wales and Northern Ireland, customers may be informed by email or telephone to the cost of the surcharge after the basket process,
confirmation and authorization by email or fax is required before the surcharge is applied and your items are dispatched.
Right to cancel:
You can cancel and withdraw from your order within 2 weeks of receiving your goods. No reason is necessary for the withdrawal, which may be given in writing (an e-mail will suffice) and-or by returning the goods by recorded means. This right will have been fulfilled if you return the goods before the expiry of this period to:

Exceptions to the right to cancel:
For goods that are deemed unsatisfactory or defected in any way the right to cancel is unaffected, where goods are signed for received in good condition and the package is clearly damaged the right to cancel may be affected, in cases of damaged goods in transit the receiver must state in writing on the consignment note: "Box" or "Package damaged" these conditions do not affect your statutory consumer rights.
Please note that the telesales law forbids the return of certain goods for example, For the supply of goods made to the customers specifications or clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly, For the supply of audio or video recordings or computer software if they are unsealed by the consumer, for the supply of newspapers and tabloids.
Payment Additional:
Goods are released for dispatch after confirmation of received payment, Goods are dispatched and delivered via carrier service where signature for receipt is required unless otherwise instructed, Usual delivery time from receipt of order is 2 to 5 working days, in the event of a delay a representative will contact you by phone or email to discuss terms of delivery or cancellation of your order.

The guarantee is given in accordance with legal requirements. Any additional guarantee statements are contained in the product descriptions, 100% money back guarantee applies to United Kingdom sales only, export sales may be liable to a carriage surcharge for returned products,
Data protection:
We store and process customer data in accordance with the current legal requirements of the Federal data protection law, the telecommunications laws and the teleservices protection law, We use customer data for the sending of newsletters from our own company which can be cancelled by the customer at any time, customer data and details are not passed on or sold on by Hobby Island ltd.

The contract or order text will be stored, You can view and store our general terms and conditions by selecting T and C on the homepage at any time, For safety reasons your orders data once processed is not available via the internet, We keep this data in confidence according to our privacy policy.
