Terms of Business
 
 
1. We are MontysFashionOutlet of Roadside Cottage, Hay-a-Park, Knaresborough, HG50SN, England. Telephone 0044 7808800095. Email rebecca@merinofashions.co.uk. Company registration no.15200667. Vat registration no. GB 450302541.
 
2. The law governing our contract is the law of England & Wales.
 
3. Our payment terms are simple. We ask for payment to be made asap after the auction ends (and within 4 days).
 
4. We reserve the right to cancel any transaction where fraud is suspected.
 
5. Our default method of payment for transactions is eBay Payments. We reserve the right to only post to your registered eBay address and to cancel any transaction where we do not receive full eBay seller protection.
 
6. The goods supplied to you are described on our sales contract. It is our responsibility to supply you with goods that conform to this description. All goods supplied are authentic items.
 
7. Our usual delivery times from the time we receive your cleared payment are: UK 2-3 working days. Europe 3-7 working days. Rest of World 3-10 working days. Please note however that due to the time taken for customs clearance (which is out of our control) then a maximum of 30 days should be allowed.
 
8. You permit us to deliver the goods to you using a ‘signed for’ service. We will insure the goods in transit. You permit any person at your delivery address (or building) to sign for goods on your behalf and such signature will constitute delivery of the goods. The goods then become your responsibility. If there is nobody available to sign then the goods will likely be held by your local post office our courier office. It is your responsibility to make contact with them and/or collect the goods.
 
9. Import duties and taxes are not included in the item price or ‘p&p’ charges. These charges are the buyer’s responsibility and are levied on customers from outside the UK. We will not mark merchandise values below value or mark items as ‘gifts’ – international government regulations prohibit such behaviour.
 
10. Our liability under the contract, including for our own negligence, is limited to the cost paid by you for the relevant goods and delivery (less any refund made).
 
Cancellation, Returns and Refunds
 
11. Unless the sales contract (for goods supplied to you) was concluded at our business premises, you will have a right to cancel within 14 days without giving any reason.
 
12. The cancellation period will expire 14 days from the date of delivery of the goods to your address.
 
13. To exercise a right to cancel, you must inform us of your decision to cancel by a clear statement e.g. by opening an ebay return or sending an ebay message or email.
 
14. If you cancel this contract, we will reimburse to you all payments received from you for the goods, including the costs of our delivery (except for any supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
 
15. Our refund will be made within 14 days of the goods being received back by us or, if earlier, within 14 days of you providing evidence that you have returned the goods.
 
16. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. Examples may include the wearing / using of items. You should also return all packaging, labels, documents and accessories etc that were originally supplied with the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
 
17. You are responsible for returning the goods safely to us and this will be at your own cost. You must send the goods to us within 14 days of communicating your intention to cancel. Please ensure you used an insured, signed for service. If you are returning goods from outside the UK, please mark the item as ‘customer return – no customs duty’.
 
18. We will refund you using the same method of payment that you used for the original transaction. You will not incur any fees as a result of the reimbursement.
