Terms & Conditions of Use Agreement
PLEASE READ THE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE PURCHASING FROM US. We maintain this eBay shop as a service to our customers, and by purchasing from our eBay shop you are agreeing to comply and be bound by the following terms of use. Please review the following terms and conditions carefully, and check them periodically for changes. If you do not agree to the terms & conditions, you should not review information or obtain goods from this eBay shop/listing.
1. Acceptance of Agreement. You agree to the terms and conditions outlined in this Terms & Conditions of use Agreement ("Agreement) with respect to our eBay shop and its listings (the "E Shop" & "Listing"). This agreement constitutes the entire and only agreement, representations, warranties & understandings with respect to the E Shop & Listing, the content, products or services provided by or through the E Shop/Listing, and the subject matter of this Agreement. This Agreement may be amended by us at any time and from time to time without specific notice to you. The latest agreement will be posted on the E Shop & our Listing, and you should review this Agreement prior to purchase.
2. Availability. In the event that goods ordered are not available & we are unable to fulfill your order it will be cancelled and any payment refunded. You will be notified of this by e-mail which will include your refund details. Where an order cannot be fulfilled because the goods ordered are not available we make no guarantee that further stock will become available at a later date, or at all. All sizes and prices are updated on a daily basis.
3. Prices & Payment. Advertised prices include VAT at the current applicable rate. Immediate payment is required after purchase. We do not accept E-Cheques. Prices are subject to change at any time without notice. Where an order has been processed, and the price of the ordered product is subsequently revised downwards for any reason, we are under no obligation whatsoever to refund the difference in price to any customer. However, where a customer has grounds for believing he/she should have received their order at the revised (lower) price, a part or full refund of the price difference is at the absolute discretion of Callitfix Ltd. We strictly only accept PayPal as a means of payment. We do not accept: Postal Order, Bankers Draft, Personal Cheque, Credit Cards or Escrow. You represent and warrant that if you are purchasing something from us that (i) any address details, phone numbers or PayPal information you supply is true, correct and complete & (ii) you will pay the charges incurred by you at the posted prices, including any shipping fees and applicable taxes.
4. Copyright. All E Shop/Listing text, design, graphics, flash and the selection and arrangement thereof, and other material on this E Shop/Listing are copyright Callitfix Ltd except brand devices or otherwise indicated. All rights reserved. You are permitted to print or download extracts from this material for your personal use only. None of this material may be used for any commercial or public use. No part of the E Shop/Listing or any material appearing on the E Shop may be reproduced or stored in or transmitted to any other E Shop or by any other media without the express permission of Callitfix Ltd. Any other use of the material and content of the E Shop/Listing is strictly prohibited. You agree that you will not (and will not assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works or such material and content.
5. Disclaimer. We accept no responsibility or liability whatsoever for any damages caused by viruses contained in the form or document. WE WILL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT FROM USE OF OR INABILITY TO USE OUR SITE. Our maximum liability to you under all circumstances will be equal to the purchase price you pay for any goods, services or information.
6. Verify Member's Address: Callitfix Ltd reserves the right to contact a Buyer via e-mail or phone to verify the accuracy of account information (including the Buyer's correct name and address) which may be needed to provide the Buyer with the goods he or she purchased from Callitfix Ltd.
7a. Delivery. All orders are dispatched within 1 business days of receiving confirmation (mon-fri). We reserve the right to delay dispatch if we are awaiting a response from a Buyer regarding their order.
In the rare event your parcel is not received but the tracking details confirm that the parcel has been delivered and signed for at the address on the order and you state you have not received the item. We have no option but to open a claim with the courier, we regret we are only able to submit a claim form 15 business days from the date the item was posted. Once the claim has been submitted, it will take 45 business days (approximately 2 months) for the courier to settle the claim one way or the other. They will not allow us to chase the claim until this period has passed. If your parcel is not received and the tracking details do not confirm that the item has been delivered correctly or at all, we will replace or refund your order within 10 days of being notified. We Regret we cannot refund / replace orders in the event that the tracking shows that the goods have been signed for at the correct address until the courier accepts our claim to the contrary. We apologise for any inconvenience that this may cause.
