SECTION 15 - SEVERABILITY
 
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
 
 
 
SECTION 16 RETURN & CANCELLATION POLICY
 
RETURN POLICY
 
You may return most items within 14 days of delivery for one time exchange, this policy apply to original list price buyer, we will not consider any exchange on discount items & custom made items (eg. custom made watch band / made to order items). Before returning the items, please notify us by e-mail. You are responsible to pay the return postage unless the items we send is in-correct, is damaged, or have missing parts. Item(s) which show clear signs of use is(are) not qualify to return. The purchase becomes effective upon the expiry of the 14-day return period. Shipping costs are not refundable unless the item is damaged or defective.
 
Incorrect or broken sent items must be notified within 24 hours and returned back before we can send out the correct one. You will receive a shipping instruction for that. Same apply for repair exchange watches.
 
Refund will be made upon arrival of the item in one of our dedicated addresses. Without a watch delivered back to us we are not able to refund.
 
 
CANCELLATION POLICY
 
Pre-Orders or orders can be cancelled at any time and the payment will be refunded 100%, if the order haven't been marked as processing in progress or shipped.

17. Shipping and Delivery
 
Upon confirmation of payment your item will be processed for shipment within 2-8 business days (MON-FRI) start counting one (1) day after the order is paid (because of worldwide time difference). A tracking code will be issued to the email you registered with. For international tracked shipments, expect a 5-8 business day delivery time for express, 8 - 35 days for economy. Our shop will not be held responsible/reliable for lost goods if an incorrect shipping address is provided or delayed shipments (Due to any reason such as Christmas overload etc.). Please note that import taxes or others (VAT, custom clearance etc.) might be charged depending on your country and they are not included into the price and it is on your responsibility (feel free to contact us for any questions). The purchased goods are sent under DDU trading terms.
 
We usually ship with DHL Express Service, EMS or China Post. In case your address is marked as REMOTE from DHL System we switch to altnerative carrier without notification, the delivery time can then vary. If you wish to receive your parcel with different carrier, please contact our support center. Supported carriers: DHL Express, 1 Express, FEDEX, UPS, EMS, China Post. Any price difference to our DHL price must be paid by customer.

In case of an unsuccessful delivery attempts to client, all costs (return-shipping, custom fees etc.) plus a handling fee of USD 20.00 must be paid by client/or will be deducted from the refund. We kindly remind you, it is customer's obligation to receive and sign for the package.
 
The customer is responsible to receive the parcel and pay the custom duty according to the country of destination. If an order is returned to us because customer did not pay custom fee or refuse to pay. All return shipping costs and import duty to our office will be deducted from the refund. The refund can only be done after receipt of the watch.
 
Delays of shippings do not lead to a refund unless the watch is delivered back to us.
 
Please notice: We declare generally USD$ 50.00 on watch purchases on the commercial invoice for the shipping carrier. In case you want another amount, please include in your ordering message (shipping note). Newwatchparadise cannot be held liable for any custom clearence.
 
Defect or broken delivered watches must be notifed us immeditaley after receipt or max. within 24 hours after receipt. It is the customers obligation to check the watch for its functionality after receipt. Without notification, the watch is considered as arrived in good condition and fully functional. After this time the replacement shipment, return shipment has to be paid by buyer. Thank you for understanding.
 
 
SECTION 18 - WARRANTY
 
Your Watch is backed by a comprehensive warranty from the original date of purchase against all manufacturing defects for 24 months . The only components covered under warranty are the hands, dial, and watch movement. If the timepiece proves to be defective in workmanship or materials under normal use, it will be repaired free of charge at the discretion of one of our Repair Centers or replaced. Please note that a return shipping fee will apply to all warranty service.
 
(a) Damage, accidental or otherwise, to the watch while in the possession of a consumer not caused by a defect in material or workmanship.
 
(b) Damage caused by accident, misuse, tampering with or failure to follow the care and special handling provisions in the Instructions.
 
(c) Damage and/or scratches to the finish of the case, crystal, bracelet, strap or other components caused by wear or accident.
 
(d) Moisture damage to a watch not marked ‘water resistant’ on the case back or damage from moisture in ‘water resistant’ models that is a result of opening the watch, broken or damaged components.
 
(e) Steam damage to any kind of watch
 
(f) Damage caused by the consumer’s failure to have the watch serviced at the consumer’s expense in accordance with the following schedule of regular maintenance.
 
(g) unauthorized opening of casebacks will lead to immediate termination of warranty.
 
SECTION 19 - DISCOUNTS
 
We usually grant a discount to bulk buyers, e-mail subscripers and bigger watch forums member.
 
Lucky Punch Deals and Pre Orders are generally excluded from promotions since their price drop is already high and limited. Only if specific mentioned, further discounts may apply.
 
SECTION 20 - PRODUCTS
 
The photos on our website are for presentation purpose only. The actual product might arrive slightly different according to year of production. Minor changes such as details in watch hands, lume, bezel inserts, crown have to be accepted by customer. To make sure about the watch, please contact customer service BEFORE purchase.
 
Misalignments on dial, chapterring, bezel inserts up to 0.2 seconds are within the tolerate zone and to be accepted by customer. Bigger misalignments need to be notified to customer service.
 
SECTION 21 - CURRENCY EXCHANGE
Our price are indicated in CHF and this price is convereted from third parties like ebay, PayPal using their modified exhange rate. Newwatchparadise cannot be held reliable for the effective Exchange Rate.
 
 
SECTION 22 - ENTIRE AGREEMENT
 
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
