His interest in basic theory as it relates to the uses and abuses of political power makes his views on a wide range of state policy issues, from taxation to criminal law, worthy of careful attention."--Reason"This is a serious, engaging, and important work of jurisprudence and political philosophy....Comprehensive in its treatment, fair-minded in the way it deals with evidence and unfailingly rigorous in its argument."--Choice, There is thought provoking material in this book which imaginative advocates can find useful, especially in mitigation, 'Barnett's libertarian argument for liberty is engagingly presented and compellingly elaborated. He writes clearly and precisely; and he also uses simple, helpful examples to prove his argument.'Constitutional Political Economy 11, 'Barnet's book is a distinctive contribution to libertarian thought. ... Barnett's analyses are ... unfailingly respectful of alternative points of view and are often unusually subtle in refuting them.'Constitutional Political Economy 11, is an enlightening book that succeeds remarkably well in drawing together a good deal of insightful analysis and presenting it in a way that would be fully intelligible even to a complete novice in political philosophy and the philosophy of law. Indeed, anyone seeking an introduction tointelligent and sophisticated legal theory would do well to start here./ Neil Simmonds/ The Cambridge Law Journal, 1999,, 'An insightful, often brilliant presentation that deserves serious attention from those of us who share this vision of the good society. This book makes an important contribution toward a more complete understanding of the structure that must underlie a society in which individuals can live inpeace and prosperity. I strongly recommend The Structure of Liberty to anyone who seeks such a society.'Bruce Benson, The freeman/Ideas on Liberty, 'Devotees of intellectual fashion whose copies ofThe Constitution of Liberty and Law, Legislation and Liberty lie gathering dust will find themselves driven to open them again as a result of this book. He also includes fascinating concrete descriptions ofhow these principles could be implemented in a society with little or nogovernment as we know it ... Synopsis
What is liberty, as opposed to license, and why is it so important? When people pursue happiness, peace and prosperity whilst living in society, they confront pervasive problems of knowledge, interest, and power. These problems are dealt with by ensuring the liberty of the people to pursue their own ends, but addressing these problems also requires that liberty be structured by certain rights and procedures associated with the classical liberal conception of justice and the rule of law. Drawing upon insights from philosophy, economics, political theory, and law, Randy Barnett examines the serious social problems that are addressed by liberty--and the background or "natural" rights and "rule of law" procedures that distinguish liberty from license. He then outlines the constitutional framework that is needed to protect this structure of liberty. Athough this controversial new work is intended to challenge specialists, its clear and accessible prose ensure that it will be of immense value to both scholars and students working in a range of academic disciplines., What is liberty, as opposed to license, and why is it so important?
